Welcome to ToolPotato

These Terms of Service ("Terms") govern your use of ToolPotato. By creating an account or using our service, you agree to these Terms. If you don't agree, that's okay — but you won't be able to use ToolPotato.

What ToolPotato does

ToolPotato provides interactive cost comparison widgets designed for GoHighLevel agencies. These widgets help you show prospects the real cost of using scattered marketing tools versus an all-in-one platform. We offer various subscription plans with different features and usage limits.

Your account

When you create a ToolPotato account, you agree to:

• Provide accurate and complete information.
• Keep your login credentials secure (don't share your password!).
• Let us know immediately if you suspect unauthorized access.
• Be responsible for all activity that happens under your account.

Acceptable use

We want ToolPotato to be a great experience for everyone. Please don't:

• Use ToolPotato for anything illegal or harmful.
• Try to reverse-engineer, hack, or break the service.
• Misrepresent your identity or affiliation.
• Scrape, crawl, or otherwise abuse our platform.
• Use the widgets to display misleading or deceptive information.

Data processing & your responsibility

This is important, so let's be clear about how data flows:

• You are the data controller. When prospects submit their personal information (name, email, phone, WhatsApp) through your ToolPotato widgets, you are responsible for how that data is used. You must have a valid legal basis (e.g. consent or legitimate interest) for collecting it.
• We are the data processor. ToolPotato receives the submitted prospect data and immediately forwards it via webhook to the endpoint you configure (typically your GoHighLevel account). We do not store prospect personal data on our servers — we only record an anonymous lead count.
• Your obligations. You agree to comply with applicable data protection laws (including the AVG/GDPR) when using ToolPotato. This means having a privacy policy on your own website that informs prospects about data collection through the widget, and ensuring your webhook endpoint handles the data appropriately.

By using ToolPotato, you authorize us to process prospect data on your behalf as described above. If you need a formal Data Processing Agreement (DPA) for your records, contact us at hello@toolpotato.com and we'll provide one.

Intellectual property

ToolPotato and its original content, features, and functionality are owned by ToolPotato and are protected by international copyright, trademark, and other intellectual property laws. Your content stays yours — we just need a license to host and display it within your widgets.

Payment & subscriptions

Paid plans are billed on a recurring basis through Stripe. You can cancel anytime from your dashboard — your access continues until the end of your billing period. We may change pricing with 30 days' notice. Refunds are handled on a case-by-case basis; if you're unhappy, reach out and we'll work something out.

Disclaimers

ToolPotato is provided "as is" and "as available." We do our best to keep things running smoothly, but we can't guarantee the service will be uninterrupted, error-free, or meet every specific need. We don't warrant that cost comparisons generated by widgets will match exact real-world pricing at all times.

Limitation of liability

To the maximum extent permitted by law, ToolPotato shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim is limited to the amount you've paid us in the 12 months before the claim arose.

Termination

We may suspend or terminate your account if you violate these Terms. You can delete your account at any time from your dashboard. Upon termination, your right to use ToolPotato stops immediately. We'll remove your personal data within 30 days of account deletion, except where legally required to retain it (e.g. invoices).

Governing law

These Terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of the Netherlands, though we'd much rather sort things out over a friendly email first.

Changes to these Terms

We may update these Terms from time to time. We'll notify you of significant changes via email or an in-app notice. Continued use after changes means you accept the new Terms.
